Statutory Maternity Pay (SMP)

First 6 weeks 90% of average weekly earnings; followed by 33 weeks at £146.68 per week or 90% of earnings (whichever is less); followed by a further 13 weeks Statutory Maternity Leave which is unpaid

§   All expectant mothers are entitled to Statutory Maternity Leave up to a maximum of 52 weeks

§   To receive SMP, an employee needs 26 weeks’ service ending with 15th week before EWC, and they must earn more than £118 per week

Statutory Paternity Pay (SPP)

£146.68 per week or 90% of average weekly earnings (whichever is less) paid for either 1 or 2 consecutive weeks to the father or mother’s partner

§   To receive SPP, an employee needs 26 weeks’ service ending with 15th week before EWC, and they must earn more than £118 per week

Statutory Adoption Pay (SAP)

First 6 weeks 90% of average weekly earnings; followed by 33 weeks at £146.68 per week or 90% of earnings (whichever is less); followed by a further 13 weeks Statutory Adoption Leave which is unpaid

§   Must be matched with a child for adoption by a UK adoption agency

§   For one adoptive parent only

§   Must earn more than £118 per week and have 26 weeks service at the end of the week in with the employee is notified of being matched with the child

Statutory Shared Parental Pay (ShPP)

£146.68 per week or 90% of average weekly earnings if this is lower

Statutory Redundancy Pay (SRP)

Number of weeks multiplied by actual average weekly wage or  maximum weekly wage of £525 / £547 (NI) (whichever is less)

Maximum number of weeks is 30; and therefore maximum SRP is £15,750 / £16,410 (NI)

§   The ‘number of weeks’ relates to the employee’s age and the completed years of service as at the date the notice period would expire

§   SRP is free from deductions for tax and National Insurance

Unfair Dismissal

Maximum basic award: £15,750 / £15,000 (NI)

§   Compensation is unlimited for successful case of whistleblowing, certain health or safety matters or discrimination arising from a ‘protected characteristic’ (race, sex, disability, sexual orientation, religion or belief, age, pregnancy/maternity, marital status/civil partnership, gender reassignment)

  • An Employment Tribunal has the power ton award £5000-20,000 for aggravated breaches of employment law
